| Recently there has been concern about mold and mildew. With home construction more airtight than ever, a small moisture leak or drainage problem could easily lead to mold & mildew. The good news is, the majority of mold is not hazardous. Rafael Floors very often works in areas, kitchens and baths, where moisture presence can lead to mold and/or mildew. | |
| With this in mind, we need you to be aware that we have found mold and/or mildew in the area of your home where we are working. Please review the following notice and either sign below for us to continue working or in the alternative, arrange for a mold inspector to find the cause and remedy the situation. | |
| NOTICE TO CUSTOMERS OF RAFAEL FLOORS CONCERNING MOLD AND/OR MILDEW | |
| We have noticed MILDEW and or MOLD in the area in which you have asked us to install floor covering. The extend of said MILDEW and/or MOLD is unknown to us but based upon our visual inspection of the portion of the premises for which we have contracted to install floor covering, and in the area which we have been able to observe, leads us to believe that the extent is _____ (minor), _____(moderate), or _____(severe), and said MILDEW and/or MOLD may extend beyond the area of our visual inspection. | |
| We are not experienced nor experts in MILDEW AND/OR MOLD ABATEMENT and strongly recommend that you contact an expert in MILDEW AND/OR MOLD ABATEMENT. We will proceed with the completion of your flooring installation only upon your agreeing, by your signature below, that we may do so absent your arranging for MILDEW and/or MOLD abatement through an expert of your choosing. By not contracting with an independent expert in mildew and/or mold abatement you have decided to assume all risks of future damages relating to said mildew and/or mold. By signing below you release us fully and completely, to the maximum extent permitted by law, of all current and future claims of any kind, including but not limited to property and personal injury claims, which may in any manner relate to MILDEW and/or MOLD at your premises and/or which may in any manner relate to MILDEW and/or MOLD migrating, becoming more severe, or otherwise being present in the future. In the event that any claim is raised against us in the future which relates to MILDEW and/or MOLD, by your signature below you agree to hold us harmless from said claims and further agree to indemnify us against any claim brought by any other person or entity. | |
